A Superior Court judge has thrown out a suit by a Tarzana strip club that argued a city ordinance banning adult entertainment venues from operating within 500 feet of a residential zone didn’t apply to them. The operators of the Frisky Kitty near Oxnard Street and Reseda Boulevard were notified in 1998 that their club operated too close to residences, violating acity ordinance. But the club’s owners argued that the language of the ordinance was unclear and challenged the rule. Judge Malcolm Mackey disagreed, ruling in favor of the city and dismissing the case before it goes to trial. The club now faces up to $5,000 in fines, but it has not been ordered to close. A hearing is scheduled for June 19, when Mackey may issue a permanent injunction.
