CABIA to Hold Rally at Supreme Court on Viking River Cruises Case

The California Business and Industrial Alliance, or CABIA, will host a rally and press conference in front of the U.S. Supreme Court on March 30 while the court hears oral arguments for a Private Attorney General Act (PAGA) case involving Woodland Hills-based Viking River Cruises Inc.

PAGA went into effect in 2004. The law allows employees of businesses to sue over labor law violations even if they were not directly impacted by the violations. Valley-based CABIA was formed to lobby against the law, which it claims unfairly penalizes employers.

Viking was sued in 2018 by former Sales Representative Angie Moriana on behalf of hundreds of workers. Moriana claimed the company violated multiple provisions of California’s wage-and-hour laws, according to a story from Bloomberg.

The cruise company said in a petition that the California Supreme Court was wrong in a 2014 case that ruled an individual employee did not have to submit to arbitration, which they agreed to, after filing a PAGA claim.

Members of CABIA will fly to Washington, D.C. on March 29, according to an email from the alliance.
